These are the terms and conditions (the “Terms”) which will apply to your purchase of food, vitamins and supplements, skin care products and other goods (“Goods”) from our website at www.biafollain.ie (the “Website”). These Terms form the basis of a legally binding contract between Bia Folláin and you. You must be over 18 years old in order to purchase anything from this website. We reserve the right to change the Terms under which the Website and the Goods are provided. Any such change will be effective to all new orders once it has been included in the text of these Terms and published on the website. The Website and all the information on it, has been created and compiled with the best interests of our customers in mind. However, the information contained on our Website and product pages may contain typographical errors or inaccuracies, for which we accept no liability. We will try and make sure that all information on the Website including descriptions and listed prices are accurate and correct at all times.
However, mistakes do happen. We will try to resolve all information errors on the Website as soon as reasonably possible and if we think within reason that such an error has affected your purchase of Goods we will try to let you know. Additionally, please note that because we take these steps we will not be liable to you for any error on the Website.

The Bia Folláin Website is a guide only and not to be used as medical advice or used to self-diagnose. It is not our intention to recommend the use of vitamin supplements, homeopathy, herbal products or any products purchased from Bia Folláin instead of qualified medical advice. We recommend that you check with your medical practitioner before taking any of our products, especially if you are on long-term medication or have started taking a prescription. The products on the Website are not intended for purchase to treat, cure or prevent any ailment or illness and results are not guaranteed for any weight management products.
The highest level of care should be taken when treating children, during pregnancy, while breastfeeding or if you have any ongoing disease or illness and we recommend that you seek the advice of a qualified healthcare professional. Your use of any information or materials on the Website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the Website meet your specific requirements. It is important that you read and understand fully the directions on the label and packaging of any product you purchase from Bia Folláin before consumption or use. The onus is on you to ensure you are satisfied to consume the purchased product.
The sale of non-prescription medicines is regulated by The Pharmaceutical Society of Ireland. As required by legislation, a record of each transaction relating to such products is retained for a period of 2 years. We are included in the Internet Supply List of registered authorised retailers. Placing Orders – Buying Goods
Orders can be made online at times that are most convenient to you. Please take note that orders will only be processed during normal business hours Monday to Friday. Bia Folláin reserves the right to refuse to sell or supply goods to any person or company for any reason.
You make an offer to purchase a product or products from Bia Folláin (known as your “Order”) by completing the ordering process on the Website in full. Your Order only constitutes an offer to purchase goods and does not form a binding contract until Bia Folláin accepts the offer. On receipt of your Order we will send an order acknowledgement to the email address you provided during the ordering process.
When payment for goods and delivery charges if applicable, have been processed we will send a confirmation order dispatch email and the sending of that actual email makes the contract between Bia Folláin and you. If a product is not available we will include details of this in the order dispatch email. You will not be charged for a product that is not available. An order is accepted by Bia Folláin only when payment in full has been processed and received and the Goods
have been dispatched.
Payment and Pricing
All prices are displayed in Euros and include VAT at the applicable rate. Delivery charges if applicable are not included. If you are purchasing with a non-euro credit card the exchange rate shown on your statement is set by your card provider and not by Bia Folláin. Bia Folláin reserves the right to change prices without prior notice and to withdraw from sale any products advertised online at any stage without prior notification.
Credit Card Security
All transactions are processed by Stripe payments. All transactions are highly encrypted and your card details are never passed on to Bia Folláin or any other party.
Account
You are responsible for your account and you must ensure that login, password and other details relating to your account are correct and confidential at all times.

Cancelling Orders & Returns
Cancelling Your Order
To cancel your order you must notify us in writing up to 10 days after your products have been delivered. Please include in the notification your order number and reason for cancellation. If you cancel your order after we have dispatched the products then you must return the products to us in good condition, unopened and in a securely wrapped parcel to Bia Folláin, Main Street, Tulla, County Clare. We recommend the use of a recorded delivery service for tracking purposes.
You can no longer cancel your order once you have opened the product containers or used the products. Bia Folláin will refund the purchase price to the payment card used at the time of purchase once the Goods are returned. Postage costs will be refunded in full in the case of incorrect or damaged orders but not where you have elected to return goods for any other reason. Nothing under these terms and conditions affects your statutory rights.
Cancellation by Us
We reserve the right to cancel the contract between us for the following reasons:
· Insufficient stock to deliver the goods you have ordered
· If we do not deliver to your area
· If one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by e-mail and refund the money to the payment card used in the purchase as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
General
Bia Folláin will not be responsible for the performance of any obligations under these terms and conditions in the case of an event outside of our reasonable control including but not limited to strikes, lockouts, failure of third parties’ systems or networks, acts of God, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or damage to or destruction of premises.
Bia Folláin warrants that the goods supplied are of satisfactory quality reasonably fit for all the purposes for which these goods are normally supplied.
